Terms and Conditions

1. Conditions of sale

The following conditions of sale are applied over all orders made with www.newdrumpercussion.com. This Site offers to Users the possibility to acquire information, to view and to buy Made in Italy handicraft products and accessories for percussion instruments.

The User must read carefully the Terms and Conditions before the sale in compliance with art. 12, paragraph 3, of Legislative Decree 2003/70 ("Ecommerce Decree").

The User, at the time of conclusion of the purchase, accepts all the conditions of this contract.

The contacts concluded with www.newdrumpercussion.com respect: the Consumer Code, the Ecommerce Decree, European laws and international treaties that regulate the matter.

2.  Customer Informations

The purchase of the products through the Site is reserved exclusively to the Customers, as individuals with an age equal or greater than 18 years (or, if minors, authorized by their legal representative).

​4. Products Informations

Products informations are available on this Site, in compliance with art. 52 e 53 of the Consumer Code.

Not all products visible on the Site are or will be available at the time of purchase. If you want one or more products not available you can contact the owner of New Drum Percussion through any communication channel, visit the Contacts section for more information.

5. Prices

The prices of our products are listed on the Site and include all applicable taxes.

We reserve the right to change our prices for products at any time and to correct any errors.

6. Mode of purchase

To buy the products you can:

1) add the products of interest to the shopping cart and complete the procedure with the shipping details and the payment method;

2) send your order to New Drum Percussion through any communication channel (WhatsApp, Messenger, call, sms, e-mail, etc).

 

When the user sends the order, he accepts all the conditions described on the Site.

These are the only ways to purchase our products.

 

New Drum Percussion does not assume the responsibilities for any purchases made through other platforms or unofficial websites, the only official Site of New Drum Percussion is "www.newdrumpercussion.com".

7. Payment methods

The payment can be made through Paypal, bank transfer, Postepay or Bank 5.

The amount must be equal to the price set and at net of the costs of taxes or commissions provided for in the payment system, these costs are charged to the Customer.

8. Transport and delivery

The products will be delivered to the address provided by the Customer.

In case of payment through bank transfer the shipping will be done after the payment.

Delivery is charged to the Customer, except in cases where the buyer reaches the minimum order to take advantage of free shipping. Clink on the Shipping link for more information.


All the purchase will be sent through express courier, from Monday to Friday, except festive days.

Delivery times may be late, New Drum Percussion will not responsible for delays that are unforeseeable and/or attributable exclusively to the courier.

To the delivery is necessary the presence of a person at the address indicated by the Customer. At the moment of delivery, the Customer must check:

  • that the number of packages delivered corresponds to the number shown on the delivery note (DDT);

  • that the packaging is intact, not damaged, nor wet or otherwise altered.

Any damage to the packaging and/ or product or the mismatch in the number of packages shall be immediately notified on the proof of delivery courier. After signing the courier document without any objection, the buyer will not be able to oppose any dispute about the external characteristics of the package delivered.


9. Cancellation order and withdrawal rights

in compliance with art. 55, paragraph 2, letter c of Consumer Code, New Drum Percussion ensures the withdrawal, the return and the cancellation rights, except in the case of custom product orders.

10. Return of the order

New Drum Percussion ensures the return of the products purchased. Only products that have obvious manufacturing defects that compromise their functionality can be return, so products that show any aesthetic defects due to the handcraft production process cannot be returned.

Some New Drum Percussion products need hardware for their operation, any incompatibility between the hardware on the market and our products is not considered object of return. To know the compatibility of our products, read the product description or the pages dedicated to its construction, if you have doubts contact us!

The ensuring does not apply for damage caused by negligence, incorrect use and installation, abuse, deterioration, weather conditions.
You have the right of withdrawal and return only if the product has obvious manufacturing defects.  The products must be returned by the Customer as new, unused and undamaged, as well with their original invoice and with the packaging New Drum Percussion.

This right may be exercised within one year from the confirmation of the order, in accordance with art. 1490 and following c.c.

​

If you want to exercise the right of return, contact New Drum Percussion through any communication channel (WhatsApp, e-mail, etc) and indicate:

  • the products you want to return;

  • photo of the manufacturing defect.

 

New Drum Percussion can:

  • refund the price of the product (without the cost of shipping) with a voucher to spend on the Site www.newdrumpercussion.com;

  • do repair work on the product.

New Drum Percussion does not assume the responsibilities for the refund of the returned products that are lost, stolen or damaged.

The shipping costs are assumed by the Customer, including any taxes.

Return costs will not be refundable.
New Drum Percussion will refund the Customer no later than 30 days from the notice of cancellation of the order or withdrawal

11. Authenticity Assurance and intellectual property rights
New Drum Percussion ensures the authenticity of the products that are are fully MADE IN ITALY

 

12. Applicable law and jurisdiction

These Terms and Conditions are governed by Italian law and must be interpreted in accordance with Italian law, Community and international laws if the tracts have been ratified by Italy.

For disputes caused by the interpretation, validity and/or execution of these conditions, the  territorial jurisdiction shall be that of the court of the seat of the producer.
